Governing Law

The relationship between visitors of the website and Globalduck Ltd, Co. Reg. No. 09567364, with its registered office at Vojtěšská 211/6, 110 00 Praha 1, registered in the Commercial Register with the Municipal Court in Prague shall be governed by the laws of the Czech Republic and EU

Customer´s behavior

We reserve the right to block the access to our websites or delete your comments at any time without stating a reason.

Visitors are also bound to abide the following rules:

a) Visitors of our websites shall not use any portion of the Globalduck websites to post, share, promote, depict, encourage, solicit or exchange content harmful to minors.

b) Visitors of our websites shall not attempt to gain unauthorized access to our database or other computer systems.

c) Visitors of our website shall not spam the comment sections and post any sort of advertising products without consent of the owner of the website.

d) Visitors of our website shall not use any portion of the Globalduck websites for unlawful purposes.

Note that the judgments of applicability are exclusively at our discretion. In case the rules are not abided, we reserve the right to block the access to our websites or delete your comments at any time without stating a reason and without a prior notice.

The Site and its original content, features, and functionality are owned by the creators of Globalduck websites. The content is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms and conditions for organisers “Terms for organisers” set out the legal agreement between each individual organiser “you” or “organiser” and Globalduck Ltd.

Terms and conditions for organisers

Basic definitions

Globalduck company – also “we” or “Globalduck” is a legal entity with Co. Reg. No. 09567364, with its registered office at Vojtěšská 211/6, 110 00 Praha 1, registered in the Commercial Register with the Municipal Court in Prague). 

Attendees – a person who attends any of our events.

Organiser (“you”) – a person who leads our events. Every organiser will get a personal account on our website. An organiser is an independent natural person or a legal entity.

Services of Globalduck company – services, which are provided by Globalduck company, including making events for organisers, preparation of the events, ensuring communication between organisers and attendees etc.

Contract – the contract is concluded between an organiser and Globalduck regarding the usage of services of Globalduck. The contract includes “Terms for organisers”.

Fee – a fee which an attendee must pay to Globalduck for their services.

Organiser’s commision – an amount of money, which is paid to organisers for leading events.

Leading an event – Organisers are present during the event and are responsible for the programme and the right management of the event as written in the specific event description.

Conclusion of the contract

Before becoming an organiser, you must register during which you will provide the required information. After successfully registering, we will provide you a personal account on our website. To finish the registration, you will have to agree with our terms and conditions and privacy policy and tick the square. With this, you declare and warrant that:

  1. You are eligible to make a contract with us.
  2. You have read the Terms for organisers and you will abide all your duties and responsibilities.
  3. All your personal and contact information will be correct.
  4. You will not use any of our services for any unlawful purposes.

After sending the registration form, you will obtain an email whether you were accepted or not. We reserve the right to revoke your registration without stating a reason.

When filling in your payment details, you are responsible for the information you provide. We are not held responsible in case you fill in incorrect information.

Leading events

  1. You hereby warrant that you will provide services in accordance with the Terms for organisers, the contract and all relevant legal regulations. Please note that you are fully responsible for any violations of any laws which occur during leading the event.
  2. You are responsible for all the equipment provided by us. In case something is damaged, you are responsible for paying all costs.
  3. In case the fee is paid in cash and on the event, you are responsible for acquiring fees from all attendees as it’s stated in our documentation about each specific event type. In case an attendee refuses to give you the money, you are obligated to tell us. And in case an attendee refuses to give you the money due to your fault (bad management of the event, fatal mistakes…), you are responsible to pay the amount of fee instead of the attendee.
  4. You acknowledge that you are required to comply with all tax obligations, which result from law in connection with leading events (income tax, social and health insurance….). If it’s needed, you must also fulfill all obligations towards employees and obligation to register them to relevant taxes.

Organiser’s commision

  1. Organiser’s commissions will be paid via a bank transfer to a bank account which organisers have given us. After we send you your commission on your bank account, we will also send you a receipt on your mail. Note that we are not held liable and will not resend you money in case we send the money to a wrong bank account due to you giving us a wrong account number. 
  2. We reserve the right to change, upgrade and (or) implement new commission plans or strategies. By continuing to be an organiser, you agree with these new commission plans and strategies.
  3. We reserve the right to not pay you the commission for an event we deem you have not organised well and not fulfilled your organiser’s duties (not following programme of the event, not sending us attendee’s fees on time…).

Globalduck and organisers

  1. You hereby acknowledge that there is no and will not be an employment contract or employment relationship between us and you. You may not act as our employee, an  intermediary or our representative.
  2. All rights and responsibilities connected with Terms of organisers or the contract can not be transferred on a third person.

Collecting fees from attendees

  1. One of the obligations of organisers is collecting fees from all attendees of their respective events and sending it on Globalduck bank account on time. Every 14 days on Mondays Globalduck will send invoices (3 days due) with the amount of fees which should be collected.
  2. Not sending the fee and resulting the invoice becoming overdue, Globalduck will send you three notifications. Third notification will follow with a penalty in the form of lowering your commission by 2,5% of the fee which you haven’t sent us. The penalty is increasing every day by 2,5%.
  3. If you don’t send us the money even after these notifications and penalties, we will be forced to terminate our cooperation and solve this issue at the court. All costs and expenses related to demanding the money is paid by the organiser(s).
  4. Organisers are fully responsible for collecting fees from attendees of their events and sending the fee to Globalduck in time.

Liabilities

  1. Globalduck and its representatives and employees are not liable for any damages that you may suffer in connection with leading our events.
  2. Globalduck is not liable for any attendees and their behavior.
  3. For violation of Terms for organisers, the contract or any laws, you are fully responsible and are obliged to pay for all our direct/indirect losses, costs, sanctions…which are a result of the violation on your side.

Duration and termination

  1. The conditions in these terms for organisers will be valid on the date of registration of the organiser on Globalduck websites.
  2. You can always terminate the contract by giving notice to Globalduck 14 days in advance. Globalduck may terminate the contract at any time without stating a reason in a form of notice at least 3 days in advance.
  3. Globalduck can block access to your account without a prior notice and stating a reason.

Terms and conditions for attendees

These Terms and conditions for attendees “terms for attendees” set out rules for attendees.

Globalduck company – also “we” or “Globalduck” is a legal entity with Co. Reg. No. 09567364, with its registered office at Vojtěšská 211/6, 110 00 Praha 1, registered in the Commercial Register with the Municipal Court in Prague). 

Attendees – a person who attends any of our events.

Fee – a fee which an attendee must pay to Globalduck for their services.

Our events

  1. Globalduck prepares and makes events, however, “organisers” are the ones leading the events. They are an independent natural person or a legal entity and not an employee of Globalduck. Disputes arising from consumer rights are resolved exclusively between attendees and organisers.
  2. After registering on an event, visitors shall follow the instructions and meet the requirements described on each specific event (for example, entrance fee). In case of not meeting the requirements, we reserve the right to cancel your entry to the event. 
  3. If an attendee participates in one of our events and doesn’t pay the fee, then they owe us money and we are allowed to demand it from them in its full amount. All costs and expenses related to demanding the money is paid by the attendee(s). 
  4. Globalduck reserves the right to cancel an attendance to an attendee without stating a reason. In this case, the fee will be refunded to an attendee.
  5. In case attendees violate our rules or behave inappropriately during an event, Globalduck and the organiser(s) reserve the right to deny an attendance to the attendee without refunding the fee.

Payments

  1. Fees for the event are paid in cash and at the event. They may also include other fees, such as transportation ticket fees, entrance fees and other fees and charges.
  2. Attendees are obliged to pay the fee for the event they have registered on.

Liabilities

  1. Globalduck and its representatives and employees are not liable for any damages that you may suffer in connection with leading our events.
  2. Globalduck is not liable for any organisers and their behavior.
  3. For violation of Terms for attendees, the contract or any laws, you are fully responsible and are obliged to pay for all our direct/indirect losses, costs, sanctions…which are a result of the violation on your side.

We have made a specific privacy policy here. There, you can read about the information we collect, for what purpose we do that and how they are being protected.

Adjustments and changes

We reserve the right to change these conditions from time to time. A notification to the updated terms of conditions will be displayed on our websites. If you do not agree to these changes, please leave our websites.
